La <strong>Audiencia Nacional<\/strong> fall\u00f3 a favor de la cantante al determinar que <strong>no se demostr\u00f3<\/strong> que hubiera residido en Espa\u00f1a <strong>m\u00e1s de 183 d\u00edas<\/strong> ese a\u00f1o, requisito indispensable para ser considerada <strong>residente fiscal<\/strong> y, por tanto, obligada a pagar el <strong>Impuesto sobre la Renta (IRPF)<\/strong> y el <strong>Impuesto sobre el Patrimonio<\/strong>.<\/p>\n\n\n\n<p>La <strong>sentencia<\/strong>, que a\u00fan puede ser recurrida, <strong>deja sin efecto las liquidaciones y sanciones<\/strong> impuestas por Hacienda y el <strong>Tribunal Econ\u00f3mico Administrativo Central<\/strong>. El tribunal concluy\u00f3 que la <strong>administraci\u00f3n no prob\u00f3<\/strong> que Shakira tuviera su <strong>domicilio fiscal en Espa\u00f1a<\/strong> en 2011, ya que su estancia en el pa\u00eds fue de <strong>163 d\u00edas<\/strong>, por debajo del umbral legal. Adem\u00e1s, se determin\u00f3 que <strong>no exist\u00edan pruebas<\/strong> de que la artista tuviera en Espa\u00f1a el <strong>centro de sus intereses econ\u00f3micos<\/strong> o <strong>v\u00ednculos familiares<\/strong> que la obligaran a tributar.<\/p>\n\n\n\n<p>El monto inicial en disputa era de <strong>55 millones de euros<\/strong> (64 millones de d\u00f3lares), pero el equipo legal de Shakira calcula que, al sumar <strong>intereses y costas judiciales<\/strong>, la cantidad a devolver supera los <strong>60 millones de euros<\/strong>. Seg\u00fan un comunicado de su representante, la agencia <strong>Llorente y Cuenca<\/strong>, este fallo <strong>pone fin a la \u00faltima cuenta pendiente<\/strong> de la cantante en Espa\u00f1a tras <strong>ocho a\u00f1os de batalla legal<\/strong>.<\/p>\n\n\n\n<p>Es relevante mencionar que, en <strong>2024<\/strong>, Shakira <strong>acept\u00f3 pagar una multa de 7,8 millones de euros<\/strong> (9 millones de d\u00f3lares) al admitir que <strong>defraud\u00f3 14,5 millones de euros<\/strong> (17 millones de d\u00f3lares) entre <strong>2012 y 2014<\/strong>, evitando as\u00ed un proceso judicial m\u00e1s prolongado. Adem\u00e1s, hace poco, un <strong>juzgado de Barcelona archiv\u00f3<\/strong> otra causa penal en su contra por un supuesto <strong>fraude de 6,6 millones de euros<\/strong> (7,7 millones de d\u00f3lares) en 2018, tras la solicitud de la Fiscal\u00eda.<\/p>\n\n\n\n<p>El tribunal tambi\u00e9n <strong>desestim\u00f3 el argumento de Hacienda<\/strong> de que Shakira manten\u00eda un <strong>v\u00ednculo conyugal<\/strong> con <strong>Gerard Piqu\u00e9<\/strong> en 2011, ya que <strong>nunca estuvieron casados<\/strong> y, adem\u00e1s, <strong>no ten\u00edan hijos menores<\/strong> residentes en Espa\u00f1a en ese momento.
