Las <strong>sanciones var\u00edan<\/strong> seg\u00fan las <strong>circunstancias del abandono<\/strong>, los <strong>da\u00f1os f\u00edsicos ocasionados<\/strong> y si la acci\u00f3n <strong>provoca la muerte del menor<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La <strong>legislaci\u00f3n<\/strong> establece que cualquier persona que, <strong>teniendo bajo su cuidado a un menor<\/strong>, lo <strong>abandone o ordene su abandono<\/strong>, enfrentar\u00e1 una <strong>pena base de 2 a 3 a\u00f1os de prisi\u00f3n menor<\/strong> y una <strong>multa de 9 a 15 salarios m\u00ednimos del sector p\u00fablico<\/strong>. Sin embargo, las <strong>penas se agravan<\/strong> en los siguientes escenarios:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Lesiones graves<\/strong>: Si el menor sufre <strong>mutilaci\u00f3n, lesi\u00f3n o discapacidad permanente<\/strong>, la sanci\u00f3n ser\u00e1 de <strong>5 a 10 a\u00f1os de prisi\u00f3n mayor<\/strong> y una <strong>multa de 10 a 20 salarios m\u00ednimos<\/strong>.<\/li>\n\n\n\n<li><strong>Muerte del menor<\/strong>: Si el abandono <strong>causa la muerte<\/strong>, la pena ser\u00e1 de <strong>10 a 20 a\u00f1os de prisi\u00f3n mayor<\/strong> y una <strong>multa de 20 a 30 salarios m\u00ednimos<\/strong>.<\/li>\n\n\n\n<li><strong>Agravante por v\u00ednculo directo<\/strong>: Si el abandono seguido de muerte es cometido por el <strong>padre, madre, tutor, maestro o persona con autoridad sobre el menor<\/strong>, la condena <strong>ser\u00e1 de 20 a 30 a\u00f1os de prisi\u00f3n mayor<\/strong> y una <strong>multa de 30 a 40 salarios m\u00ednimos del sector p\u00fablico<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">La <strong>Ley 44-26<\/strong> tambi\u00e9n <strong>incluye la responsabilidad penal para empresas<\/strong> (personas jur\u00eddicas) que cometan <strong>infracciones contra la filiaci\u00f3n<\/strong>, las cuales podr\u00e1n ser <strong>sancionadas con multas, disoluci\u00f3n legal o penas complementarias<\/strong>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\ud83d\udccc Hashtags:<\/strong> <code>#Protecci\u00f3nInfantil #C\u00f3digoPenalRD #Ley4426 #AbandonoDeMenores #DerechosDeLosNi\u00f1os #PenasSeveras #JusticiaDominicana #ResponsabilidadLegal #Filiaci\u00f3n #SeguridadJur\u00eddica<\/code><\/p>\n","protected":false},"excerpt":{"rendered":"<p>El nuevo C\u00f3digo Penal dominicano, mediante la Ley 44-26, intensifica las penas por abandono de ni\u00f1os, ni\u00f1as y adolescentes, estableciendo condenas de hasta 30 a\u00f1os de prisi\u00f3n para padres, madres o tutores que cometan este delito.
