{"id":48486,"date":"2024-02-23T09:44:09","date_gmt":"2024-02-23T13:44:09","guid":{"rendered":"https:\/\/romanticany.com\/?p=48486"},"modified":"2024-02-23T09:44:09","modified_gmt":"2024-02-23T13:44:09","slug":"rd-tse-desestima-accion-de-ramfis-contra-la-jce","status":"publish","type":"post","link":"https:\/\/romanticany.com\/?p=48486","title":{"rendered":"RD: TSE desestima acci\u00f3n de Ramfis contra la JCE"},"content":{"rendered":"\n<p><em>Santo Domingo.- El Tribunal Superior Electoral (TSE) declar\u00f3 inadmisible la acci\u00f3n de amparo electoral incoada por Luis Jos\u00e9 Ramfis Rafael Dom\u00ednguez Trujillo contra la Junta Central Electoral por existir otra v\u00eda jurisdiccional para reclamar los derechos alegadamente vulnerados.<\/em><\/p>\n\n\n\n<p>Los jueces Ygnacio Pascual Camacho Hidalgo, juez presidente; Rosa P\u00e9rez de Garc\u00eda; Pedro Pablo Yermenos Forastieri; Fernando Fern\u00e1ndez Cruz y Hermenegilda del Rosario Fondeur Ram\u00edrez, jueces titulares, en su decisi\u00f3n explican que la otra v\u00eda para reclamar sus derechos es la impugnaci\u00f3n contra resoluciones de admisi\u00f3n o rechazo de propuestas de candidaturas, habilitado por el art\u00edculo 151 de la Ley n\u00famero 20-23, Org\u00e1nica de R\u00e9gimen Electoral.<\/p>\n\n\n\n<p>El dispositivo de la sentencia consigna que \u201cacoge el medio de inadmisi\u00f3n planteado por la parte accionada, en consecuencia, declara inadmisible la presente acci\u00f3n de amparofecha electoral incoada en ocho de enero de dos mil veinticuatro por el se\u00f1or Luis Jos\u00e9 Ramfis Rafael Dom\u00ednguez Trujillo contra la Junta Central Electoral, en virtud de lo previsto en el art\u00edculo 70, numeral 1, de la Ley n\u00fam. 137-11, Org\u00e1nica del Tribunal Constitucional y de los procedimientos constitucionales, as\u00ed como el art\u00edculo 132, numeral 1, del Reglamento de Procedimientos Contenciosos Electorales, por existir otra v\u00eda jurisdiccional para reclamar los derechos alegadamente vulnerados\u201d.
