{"id":72892,"date":"2025-02-16T18:16:33","date_gmt":"2025-02-16T18:16:33","guid":{"rendered":"https:\/\/romanticany.com\/?p=72892"},"modified":"2025-02-16T18:16:35","modified_gmt":"2025-02-16T18:16:35","slug":"tc-y-tsa-rechazan-recurso-de-inconstitucionalidad-presentado-por-altice-y-claro","status":"publish","type":"post","link":"https:\/\/romanticany.com\/?p=72892","title":{"rendered":"TC y TSA Rechazan Recurso de Inconstitucionalidad Presentado por Altice y Claro"},"content":{"rendered":"\n<p><strong>INDOTEL Confirma Legalidad de Resoluci\u00f3n sobre Roaming Nacional<\/strong><\/p>\n\n\n\n<p>El Tribunal Constitucional (TC) y el Tribunal Superior Administrativo (TSA) de Rep\u00fablica Dominicana han rechazado el recurso de inconstitucionalidad presentado por Altice Dominicana y la Compa\u00f1\u00eda Dominicana de Telecomunicaciones (Claro), contra la Resoluci\u00f3n n\u00famero 070-2023 emitida por el Instituto Dominicano de las Telecomunicaciones (INDOTEL).<\/p>\n\n\n\n<p>En su sentencia, el TC rechaz\u00f3 el recurso presentado por Altice y Claro, confirmando que no se est\u00e1 limitando el derecho de propiedad de las prestadoras de la red. Adem\u00e1s, el TSA, a trav\u00e9s de su Cuarta Sala, decidi\u00f3 los recursos contenciosos interpuestos, ratificando la facultad que la Ley General de Telecomunicaciones le da al INDOTEL para adoptar la resoluci\u00f3n.<\/p>\n\n\n\n<p>La resoluci\u00f3n establece que no se est\u00e1 limitando el derecho de propiedad de las prestadoras de la red, sino que se busca asegurar el derecho de informaci\u00f3n y comunicaci\u00f3n seg\u00fan las disposiciones de este texto legal. Esto permitir\u00e1 que, mediante un proceso autom\u00e1tico de autenticaci\u00f3n, registro y activaci\u00f3n, se facilite la prestaci\u00f3n de servicios m\u00f3viles por operadores, promoviendo la competencia y mejorando la calidad del servicio.<\/p>\n\n\n\n<p>El INDOTEL explic\u00f3 que las aver\u00edas o problemas con el servicio mientras utilizan el Roaming Nacional ser\u00e1n atendidas directamente por su prestador de servicio e incentivar\u00e1 la competencia entre un mayor n\u00famero de operadores a trav\u00e9s de la reducci\u00f3n de las limitaciones de cobertura geogr\u00e1fica.<\/p>\n\n\n\n<p>El reglamento establece que ambas prestadoras (de red de origen y red visitada) cuenten con condiciones t\u00e9cnicas adecuadas para que se puedan prestar servicios m\u00f3viles por operadores, pudiendo reducir la concentraci\u00f3n de mercado.<\/p>\n\n\n\n<p>El INDOTEL sostuvo que las prestadoras interconectadas estar\u00e1n llamadas a facilitar esta herramienta a nivel de sus redes, minimizando las limitaciones de cobertura geogr\u00e1fica.<\/p>\n\n\n\n<p>El INDOTEL tambi\u00e9n inform\u00f3 que los usuarios ser\u00e1n informados por su prestador de servicio sobre las zonas de cobertura y los precios del servicio de Roaming Nacional, garantizando as\u00ed la transparencia y calidad del servicio.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>INDOTEL Confirma Legalidad de Resoluci\u00f3n sobre Roaming Nacional El Tribunal Constitucional (TC) y el Tribunal Superior Administrativo (TSA) de Rep\u00fablica Dominicana han rechazado el recurso de inconstitucionalidad presentado por Altice Dominicana y la Compa\u00f1\u00eda Dominicana de Telecomunicaciones (Claro), contra la Resoluci\u00f3n n\u00famero 070-2023 emitida por el Instituto Dominicano de las Telecomunicaciones (INDOTEL).
